PALIWANAG
Layunin ng mungkahing batas na ito na magtatag ng isang Kanlungan Para sa Walang Tahanan sa Unang Distrito ng Nueva Ecija para sa mahihirap at sa mga walang kakayahang suportahan ang kanilang sarili.
Sa pagsisikap tungo sa isang makatarungan at dinamikong kaayusang panlipunan, dapat na maglaan ang Estado ng sapat na serbisyo at programang panlipunan para sa paglunas sa kahirapan. Layunin namin ang pinabuting kalidad ng buhay para sa ating mga mamamayan sang-ayon sa patakarang ipinahayag ng Estado na pahalagahan ang dignidad ng lahat ng tao (Artikulo 2, Seksiyon 11 ng Konstitusyon ng Pilipinas). Sa kanilang walang masilungan, ang kanlungan para sa walang tahanan ay magsisilbing lugar na pansamantala nilang matitigilan sa gitna ng malupit na katotohanan ng kahirapan.
Ang pagpasa ng panukalang batas na ito ay hinihiling.

ISANG BATAS NA NAGTATATAG NG KANLUNGAN PARA SA WALANG TAHANAN SA UNANG DISTRITO NG NUEVA ECIJA, PAGLALAAN NG PONDO PARA DITO AT PARA SA IBA PANG LAYUNIN
Hayaang pagpasiyahan ng Senado at ng Mababang Kapulungan ng Pilipinas sa Kongreso na nagtitipon:
SEKSIYON 1. Ang pagtatatag ng isang Kanlungan para sa Walang Tahanan sa Unang Distrito ng Nueva Ecija ay isasagawa ng Department of Social Welfare and Development (DSWD).
SEKSIYON 2. Layunin ng Kanlungan para sa Walang Tahanan ang mga sumusunod:
a. magbigay ng pansamantalang matitigilan sa mga mahihirap sa distrito;
b. magbigay ng panandaliang akomodasyon sa mga mamamayan ng distrito na walang matigilan dahil sa kalamidad at sakunang likha ng kalikasan.
SEKSIYON 3. Inilalaan kung gayon ang halagang Dalawang Milyong Piso (Php2,000,000.00) para sa layuning ito, ikakarga sa kasalukuyang apropriyasyon ng DSWD sa ilalim ng Batas sa Kalahatang Apropriyasyon. Pagkaraan, ang kaukulang yunit ng lokal na gobyerno ang magsasagawa ng pagmamantini ng Kanlungan para sa Walang Tahanan.
SEKSIYON 4. Pagkabisa – Ang batas na ito ay magkakabisa labinlimang (15) araw pagkatapos na ito ay malathala sa dalawa (2) man lamang na pahayagan ng malawakang sirkulasyon.

Explanation of Vote to House Bill No. 2417 (Fil)
PALIWANAG HINGGIL SA BOTO– Kongresman Eduardo Nonato N. Joson

Ako ay bumoboto ng NO sa House Bill No. 2417 sa mga sumusunod na dahilan:
Una, sa ilalim ng ating Saligang Batas, Kgg. na Speaker, nilimitahan ang termino ng paglilingkod para maiwasan ang monopolyo sa mga puwestong ibinoboto para sa isang yugtong walang pagtatakda sa panahon. Sa panukalang batas na ito, ang monopolyo ng paglilingkod sa yugtong walang pagtatakda sa panahon ay magiging hindi magandang paunang kaso o halimbawa at maituturing na pabuya o sadyang bahagi na ng korupsiyong sistemiko o systemic corruption at mumurahing pamumulitika sa level ng barangay.
Higit na mahalaga, Kgg na Speaker, ang taumbayan mismo, ang mga botante sa ilalim ng karapatan nilang iboto ang ating mga lider—na tinatawag kong ang pamamayani ng taong-bayan o rule of the sovereign—ang siyang tanging may kapangyarihang bumoto, at hindi ito puwedeng ibigay sa kinatawan, o labagin ng kanilang mga ahente. Tayo ay mga kinatawan o ahente ng taumbayan, Kgg. na Speaker. Hindi natin puwedeng lampasan o higitan ang pinagmulan ng kapangyarihan. Sa ibang salita, habang may kapangyarihan tayong itakda ang termino ng tanggapan ng mga opisyal ng barangay, at ang ekstensiyon ng termino ay bahagi lamang ng awtoridad na itakda ang termino ng tanggapan, ang naturang ekstensiyon ay dapat na umangkop sa diwa ng batas sa limitasyong pangtermino, sa kwalipikasyon sang-ayon sa batas (lalo na ng kandidatong pang-Sanggunian Kabataan sa kasong ito) at pananagutan pagkaraan ng itinakdang termino o ng isang bagong mandato mula sa taumbayan mismo. Hindi para sa mga ahente o kinatawan ang magbigay ng renewal o ekstensiyon ng naturang mandato. Kung hindi, magkakaroon dito ng paghalili ng desisyon o substitution of judgement o ng pag-angkin ng kapangyarihan.
Ikalawa, Kgg. na Speaker, bagamat mayroon ng pagwawasto sa anyo at sa pagtuturing sa regularidad ng pagpapasa sa panukalang batas na ito sa una at ikalawang pagbasa, hindi nasisiyahan ang kinatawan ito sa pamamaraan sa pagpapasa ng panukalang batas na ito. Kahit ang bersiyon ng ika-3 pagbasa ay hindi nagpapakita ng pagwawasto sa journal na dapat na isinagawa bago ang paglilimbag at distribusyon ng nasabing ika-3 bersiyon. Dapat nating tandaan, Kgg. na Speaker na dahil tayo mismo ang gumagawa ng alituntunin, nasa atin ang tungkulin upang mahigpit na sundin o amyendahan o suspendihin ang naturang mga alituntunin, kung kailangan. Kung hindi Kgg. na Speaker, tayo ay magiging tagalabag sa halip na tagalikha ng batas.
Sa huli, Kgg. na Speaker, kaugnay ng pagtataguyod sa panukalang batas na ito, naniniwala ako na ang deliberasyon ay dapat na palagiang tumuon sa isyu o paksang pinag-uusapan. Totoong puwedeng mag-init ang damdamin, ngunit ang mga pahayag o salita ay hindi dapat ipatama sa mga personalidad na kalahok sa talakayan o debate. Kaya, kung nasaktan ng kinatawang ito ang tagapagtaguyod, ako ay humihingi ng paumanhin sa tagapagtaguyod at sa kalipunang ito para sa pahayag o wikang ginamit dito. Ang mabuting kalooban ay palaging ipinapasubali. Nararapat na panatilihin ang kagandahang-asal at pagrespeto sa isa’t isa. Dapat na palagiang mangibabaw ang ating mabuting kalooban kung mamumuno tayo sa pamamagitan ng mabuting halimbawa. Nagugutom at nauuhaw ang taumbayan, Kgg. na Speaker. Hindi tayo maaaring magkulang pa.

EXPLANATION OF VOTE – Congressman Eduardo Nonato N. Joson
(Delivered on September 10, 2007, House of Representatives)
I vote NO to House Bill No. 2417 for the following reasons:
First, under our Constitution, Mr. Speaker, term limits were imposed so as to preclude monopoly of the elective position for an indefinite period of time. With this bill, a monopoly for an indefinite period of time becomes an unwelcome precedent and will be seen as a reward or as part and parcel of systemic corruption and cheap politicking for leaders at the barangay level.
More importantly Mr. Speaker, the people themselves, or the electorate under their right to elect our leaders -- which I termed as the rule of the sovereign -- has the sole power to elect, which cannot be delegated nor circumvented by their representatives. We are merely the representatives or agents of our people, Mr. Speaker. We cannot rise higher than the source. In other words, while we have the authority to fix the term of office of barangay officials, and an extension of the term is only part of the authority to prescribe the term of office, said extension must conform to the spirit of the law on term limitations, with the qualification requirements prescribed by the law (especially for Sangguniang candidates in the instant case), and accountability at the end of the prescribed term or a new mandate coming from the people themselves. It is not for the agents or representatives to provide for a renewal or extension of such mandate. Otherwise, a substitution of judgement or an arrogation of power will take place.
Secondly Mr. Speaker, although there has been a correction as to form and presumption of regularity on the passage of the bill on first and second reading, this representation is not satisfied with the procedural requirements for the passage of the bill. Even the 3rd reading version does not reflect the correction to the journal which should have been done before the printing and distribution of said 3rd reading version. We must remember Mr. Speaker that because we ourselves make the rules, it is incumbent upon us to strictly follow, amend or even suspend said rules, if necessary. Otherwise Mr. Speaker, we become the lawbreakers instead of lawmakers.
Lastly, Mr. Speaker, as to the sponsorship of the bill, I believe that the deliberations must always focus on the issue or subject matter at hand. Admittedly passions will rise because of the heat of the moment,but remarks or language used must never be directed to the personalities involved in the discussion or debate. Therefore, if this representation has somehow touched a raw nerve on the part of the sponsor, my apologies to the sponsor and to this body, for such remark or language used. Good faith is always presumed. Civility and mutual respect is always a must. Our best side must always prevail if we are going to lead by example. Our people hunger and thirst Mr. Speaker. So We can do no less.

WHEREAS, due to the “Hello Garci tape” controversy, the legitimacy of the Arroyo administration has been undermined, questioned and challenged in almost all available fora;
WHEREAS, the adverse effects of the “Hello Garci” controversy to our political stability; electoral process and society in general, continue to hound the Arroyo administration as well as the nation and electorate in particular;
WHEREAS, other negative contributory factors such as alleged human rights violations, corruption and political persecution eroded the credibility, trust and confidence of the people in the Arroyo administration;
WHEREAS, the 2007 elections, particularly the senatorial race and the results thereof, may be considered as a referendum or vote of confidence/or no confidence vote on the performance, trustworthiness and credibility of the Arroyo administration;
WHEREAS, the results of the senatorial race clearly showed the voice of the people as having decided in favor of the opposition or in effect a vote of no confidence on the Arroyo administration;
WHEREAS, be resolved as it is hereby resolved, to express the sense of the Congress of the Republic of the Philippines, to urge the President Gloria Macapagal Arroyo and Vice-president Noli De Castro to resign from office and thereafter hold special elections as provided for in our constitution.

SAPAGKAT, dahil sa kontrobersya ng “Hello Garci tape”, ang pagka lehitimo ng administrasyong Arroyo ay naparupok, tinatanong, napag-alinlanganan at hinamon sa halos lahat ng maaaring pagdalang for a o lugar;
SAPAGKAT, ang mga masamang epekto ng kontrobersya na dulot ng “Hello Garci tape” sa katatagang political, proseso ng halalan at sa ating lipunan sa pangkalahatan, ay patuloy na bumabagabag sa administrasyong Arroyo pati na sa bansa at mga botante sa particular;
SAPAGKAT, dahil sa iba pang negatibo at dagdag pang pangyayari gaya ng mga alegasyon sa paglabag sa karapatang pantao, korapsyon at pag-usig politikal ay umubos sa kredibilidad, pagtitiwala at kompiyansa ng bayan sa administrasyong Arroyo;
SAPAGKAT, ang 2007 eleksyon, lalo na ng labanan sa senador at resulta nito, ay maituturing na isang referendum o boto nhg pagtitiwala/ o boto ng walang pagtitiwala sa pagganap ng tungkulin, pagtitiwala at kredibilidad ng administrasyong Arroyo;
SAPAGKAT, malinaw na naipakita, sa resulta ng labanan sa senador, ang boses o kapasiyahan ng taong-bayan na pumanig sa oposisyon o sa ibang salita, umiral ang boto ng walang pagtitiwala sa administrasyong Arroyo;
DAHIL DITO, pinagtitibay at sa ngayon ay pinagtibay, na ipahiwatig ang pananaw ng Kongreso ng Republika ng Pilipinas, na hikayating magbitiw sa tungkulin sa Pangulong Gloria Macapagal Arroyo at Pangalawang Pangulo Noli De Castro at pagkatapos noon ay magsagawa ng tanging halalan para sa Pangulo at Pangalawang Pangulo sang-ayon sa ating saligang batas.

SAPAGKAT, dahil sa kontrobersya ng “Hello Garci tape”, ang pagka lehitimo ng administrasyong Arroyo ay naparupok, tinatanong, napag-alinlanganan at hinamon sa halos lahat ng maaaring pagdalang for a o lugar;
SAPAGKAT, ang mga masamang epekto ng kontrobersya na dulot ng “Hello Garci tape” sa katatagang political, proseso ng halalan at sa ating lipunan sa pangkalahatan, ay patuloy na bumabagabag sa administrasyong Arroyo pati na sa bansa at mga botante sa particular;

With the help of professionals and a treatment facility specifically equipped to address their needs, drug dependents can once again become productive members of our society.

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION. 1. The establishment of a Drug Rehabilitation Center in the First District of Nueva Ecija shall be undertaken by the Department of Health (DOH)
SECTION 2. The Drug Rehabilitation Center shall have the following functions:
a. provide temporary accommodations to drug dependents;
b. provide medical care, guidance counseling to drug dependents admitted in the center;
c. provide after-care and follow-up services to enable a drug dependent to reintegrate with society
SECTION 3. The amount of Two Million Pesos (Php2,000,000.00) is hereby appropriated for this purpose, charged to the DOH’s current appropriation under the General Appropriations Act. Thereafter, the concerned local government units shall undertake the maintenance and operation of the Drug Rehabilitation Center.
SECTION 4. Effectivity – This Act shall take effect fifteen (15) days after its publication in at least two (2) newspapers of general circulation.

Nagtataguyod ang gayong mga gawain ng kalahatang kalusugan, pisikal at mental, nagpapatimo ng halagahang moral at panlipunan, bukod sa naglalaan ng pagkakataon para mahikayat ang pagkamalikhain at diwa ng kooperasyon ng tao.

Layunin ng mungkahing batas na ito na makapagtatag ng Crisis Center for Women sa Unang Distrito ng Nueva Ecija, isang pagkilala sa nakadeklarang patakaran ng Estado na bigyang-halaga ang dignidad ng bawat tao at ang ganap na pagggalang sa karapatang pantao (Artikulo II, Seksiyon 11 ng Konstitusyon ng Pilipinas).
Nakababahala ang laganap na mga salaysay ng karahasan laban sa kababaihan. Ang karahasang domestiko, pambugbog, pang-aabusong sexual at harassment, eksploytasyon at trafficking ang ilan sa paglabag sa karapatang pantaong dinadanas ng kababaihan sa ating lipunan. Ang mga biktima ng gayong karahasan ay karaniwang dinadanas ang karahasan dahil sa kakulangan ng resorses o serbisyo na makakatulong sa kanilang pangangailangan.
Nauunawaan ng awtor na isang paraan upang matugunan ang problema ng karahasan laban sa kababaihan ang pagtatayo ng isang crisis center na sadyang nakalaan sa pangangailangan ng kababaihan. Kailangan ang pook, pangangalaga sa bata, tulong medikal, payong sikolohikal at tulong legal para mailigtas ang mga survivor ng pang-aabuso at tulungan silang makabalik sa pagiging produktibong miyembro ng ating lipunan.
Mahalaga ang papel ng kababaihan sa pagbuo ng nasyon. Tungkulin ng Estado na bigyan sila ng proteksiyon at pamamaraan upang maisakatuparan ang kanilang papel sa lipunan..
Ang pagpasa ng panukalang batas na ito ay hinihiling.

ISANG BATAS NA NAGTATAYO NG CRISIS CENTER FOR WOMEN SA UNANG DISTRITO NG NUEVA ECIJA, PAGLALAAN NG PONDO PARA DITO AT PARA SA IBA PANG LAYUNIN
Hayaang pagpasiyahan ng Senado at ng Mababang Kapulungan ng Pilipinas sa Konggreso na nagtitipon:
SEKSIYON 1. Ang pagtatatag ng Crisis Center for Women sa Unang Distrito ng Nueva Ecija ay isasagawa ng Department of Social Welfare and Development (DSWD).
SEKSIYON 2. Ang mga kababaihang biktima ng karahasan sa mga tahanan, pang-aabusong sexual at harassment, eksploytasyon at trafficking ay mabibigyan ng mga serbisyo ng Crisis Center for Women na mapapailalim sa pangangasiwa at administrasyon ng DSWD.
SEKSIYON 3. Kabilang sa gawain ng Crisis Center ang mga sumusunod:
a. maglaan ng pansamantalang kalinga sa mga inabusong babae at kanilang mga anak kung mayroon;
b. magsagawa ng tulong medikal o payong sikolohikal sa mga biktima, kung kailangan;
c. magbigay ng tulong legal sa mga biktima ng pang-aabuso kung kailangan;
d. magbigay ng pagsasanay sa kakayahan o tulong pangkabuhayan sa mga dumanas ng karahasan laban sa kababaihan.
SEKSIYON 4. Ang halagang Dalawang Milyong Piso (Php2,000,000.00) ay inilalaan ngayon para sa layuning ito, ikakarga sa kasalukuyang nakalaang pondo ng DSWD sa ilalim ng General Appropriations Act. Pagkaraan, ang kinauukulang mga yunit ng lokal na gobyerno na ang mangangalaga ng Crisis Center for Women.
SEKSIYON 5. Pagkabisa – Ang batas na ito ay magkakabisa labinlimang (15) araw pagkatapos na ito ay malathala sa dalawa (2) man lamang na pahayagan ng malawakang sirkulasyon.

Layunin ng mungkahing batas na ito na makapagtatag ng Crisis Center for Women sa Unang Distrito ng Nueva Ecija, isang pagkilala sa nakadeklarang patakaran ng Estado na bigyang-halaga ang dignidad ng bawat tao at ang ganap na pagggalang sa karapatang pantao (Artikulo II, Seksiyon 11 ng Konstitusyon ng Pilipinas).
Nakababahala ang laganap na mga salaysay ng karahasan laban sa kababaihan. Ang karahasang domestiko, pambugbog, pang-aabusong sexual at harassment, eksploytasyon at trafficking ang ilan sa paglabag sa karapatang pantaong dinadanas ng kababaihan sa ating lipunan. EXPLANATORY NOTE
This bill seeks to establish a Crisis Center for Women in the First District of Nueva Ecija, recognizing the State’s declared policy of giving value to the dignity of every human person and full respect for human rights (Article II, Section 11 of the Philippine Constitution).
The widespread accounts of violence against women are alarming. Domestic violence, battering, sexual abuse and harassment, exploitation and trafficking are among the human rights abuses suffered by women in our society. Victims of such abuses often have to suffer violence for lack of resources or services which can assist them in their needs.
The author recognizes that one way to address the problem of violence against women is to provide a crisis center particularly geared to women’s needs.Shelter, childcare, medical aid, psychological counseling and legal assistance are necessary to save the survivors of abuse and help them regain their place as productive members of our society.
Women have a vital role in nation building. It is the State’s duty to provide them protection and the means to realize their role in our society.
Hence, approval of this bill is earnestly sought.

AN ACT ESTABLISHING A CRISIS CENTER FOR WOMEN IN THE FIRST DISTRICT OF NUEVA ECIJA, APPROPRIATING FUNDS THEREFOR, AND FOR OTHER PURPOSES
Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION. 1. The establishment of a Crisis Center for Women in the First District of Nueva Ecija shall be undertaken by the Department of Social Welfare and Development (DSWD).
SECTION 2.Women who are victims of domestic violence, battering, sexual abuse and harassment, exploitation and trafficking may avail of the services of the Crisis Center for Women, which shall be under the management and administration of the DSWD.
SECTION 3.The Crisis Center for Women shall have the following functions:
a. Provide temporary refuge to abused women and their children, if any;
b. Render medical assistance or psychological counseling to victims, if needed;
c. Provide legal assistance to victims of abuse, when necessary;
d. Provide skills training or livelihood assistance to survivors of violence against women.
SECTION 4.The amount of Two Million Pesos (Php2,000,000.00) is hereby appropriated for this purpose, charged to the DSWD’s current appropriation under the General Appropriations Act. Thereafter, the concerned local government units shall undertake the maintenance of the Crisis Center for Women.
SECTION 5. Effectivity – This Act shall take effect fifteen (15) days after its publication in at least two (2) newspapers of general circulation.
